Frank
Brier obtains Summary Judgment on the discovery rule
under the statute of limitations granted immediately
prior to start of trial.
On
August 9, 2004, Frank Brier successfully obtained summary
judgment on behalf of his physician-client on the basis
of a statute of limitations argument. The court held
that the plaintiff knew of the alleged negligence within
the original two year statute of limitations and he
failed to initiate suit in a timely manner.
