Amy Shwed successfully defends a cardio-thoracic surgeon against allegations of negligence related to a Fogarty Balloon Embolectomy.

Plaintiffs alleged that the surgeon improperly used a Fogarty Balloon Catheter during an emergent embolectomy procedure, leading to the death of the decedent. Plaintiffs alleged that the physician had damaged his artery during the removal of a blood clot from in the femoral artery. According to Plaintiffs’ experts, this damage led to the formation of a new clot that led to a second surgery, a heart attack and eventually death. Attorney Shwed presented expert testimony to establish that the second blood clot was not caused by the embolectomy, but rather had formed after the patient’s stroke. The expert testified that the second surgery was absolutely unpredictable and necessary to remove the second blood clot from the patient’s femoral artery. Finally, Attorney Shwed presented evidence that the Plaintiff did not die from any damage to his femoral artery, but rather after experiencing an unpredictable myocardial infarction because of his previously damaged heart. The jury rejected the Plaintiffs’ claim and returned with a verdict in favor of the Defendant in under one hour.
