Paul Wylam secures defense verdict for orthopedic surgeon.

Following binding arbitration in October 2007, an arbitrator decided in favor of the orthopedic surgeon and against the Plaintiff.  The surgeon was accused of failing to properly align Plaintiff’s left leg and negligently cutting Plaintiff’s right ACL.  The surgeon performed the surgery to repair the Plaintiff’s bilateral femur fracture, which he sustained in a dirt bike accident.

During the arbitration, Plaintiff’s attorney presented live testimony from Plaintiff and Plaintiff’s mother.  Also, Plaintiff’s attorney submitted a videotape testimony of Plaintiff’s expert orthopedic surgeon and a subsequent treating orthopedic surgeon, and an opinion of another expert by way of an expert report.  On behalf of the defense, Mr. Wylam presented live testimony from the Defendant and the videotaped testimony of Defendant’s expert orthopedic surgeon.

Mr. Wylam was able to show that malalignment is an unfortunate risk and complication associated with bilateral femur fracture repair surgery, and that there was no evidence to support that the surgeon caused Plaintiff’s ACL tear.
