Regional hospital dismissed in medical malpractice action.
Attorney John Hill of our Bethlehem office was successful in having a regional hospital dismissed in a significant medical malpractice action at the close of Plaintiff’s case – in-chief. The case involved allegations that the hospital and other healthcare professionals failed to timely diagnose and treat the Plaintiff with lung cancer, which, due to the alleged diagnosis, metastasized to the Plaintiff’s brain.
Attorney Hill was successful in challenging the adequacy of Plaintiff’s expert such that the Trial Judge precluded a key causation expert from testifying at time of trial. Without such testimony, Attorney Hill was able to have the case dismissed when the Plaintiff’s attorney rested after the third day of trial.
