Attorney Hill successfully defends a local Obstetrician/Gynecologist in a brain damaged baby lawsuit
In January 2008, Attorney John Hill of our Bethlehem office successfully defended a local obstetrician/gynecologist in a lawsuit filed on behalf of a minor where it was alleged that there was a delay in performance of a cesarean section which resulted in the child suffering from permanent and severe brain damage including autistic disorder and mental retardation.
In October of 1995, an obstetrician allegedly delayed in delivering by way of cesarean section an infant thereby resulting in the infant sustaining permanent and severe brain damage. The lawsuit was brought seven years after the child’s birth, with Plaintiff’s counsel alleging that but for the delay in delivery the infant would have had a normal upbringing and life expectancy.
During the 9-day trial, several experts were called by both the Plaintiff and defense counsel. Attorney Hill utilized the expertise of an obstetrician/gynecologist, a fetal maternal expert, a pediatric neurologist and a pediatric neuroradiologist to establish that the actions of the obstetricians met the standard of care and did not cause the harm to the child. After nine days of trial, Attorney Hill obtained a defense verdict.
