February 2010: Mark Perry Obtains a Defense Verdict for a Cardiologist in Wrongful Death Action Following Two-Week Trial

Mark successfully defended a cardiologist, obtaining a defense verdict after a two-week trial in Luzerne County.  The Decedent was a fifty-three year old, who suffered a significant heart attack and was treated at a tertiary care hospital.  He was then released and treated by the Defendant cardiologist, as well as a Co-Defendant cardio thoracic surgeon, and scheduled for surgery.  The Decedent died several days prior to his elective surgery.  The Plaintiffs claimed the Decedent’s condition warranted urgent surgery that should have been scheduled earlier than the elective surgery which was scheduled by the Defendant physicians.  The Defendants successfully argued that the Decedent’s condition was stable and therefore did not warrant earlier scheduling of surgery.  The Defendants also argued that the Decedent’s death was actually caused by an arrhythmia, which could have occurred even had the surgery been scheduled earlier.  The jury only deliberated for approximately one hour before rendering a unanimous verdict for all of the Defendants.
