Jury
clears doctor in nail injury case

A
Lackawanna County jury Tuesday did not find that an
emergency room doctor damaged a man's sciatic nerve
while removing a nail from his buttocks.
Robert
and Marissa Barcola, 523 Moosic Road, Old Forge, were
seeking $5 million for the injury -- the result of a
nail fired by a pneumatic gun -- which left the man
dependent on a cane.
The
defendants were Dr. William Dempsey, who was represented
by attorneys Mark Perry and Paul Wylam, and Community
Medical Center, represented by attorney Michael Perry.
The
defense stressed that the nerve injury could have occurred
when the nail was fired into Mr. Barcola by his brother-in-law
while the two were working on the roof at the Throop
Civic Center on March 12, 1997.
The
plaintiffs' attorney, Melissa Scartelli, said it was
during the extraction process that Dr. Dempsey injured
Mr. Barcola, who was also represented by attorney Joseph
Lach.
